These Terms govern your use of ProfitForge AI (the "Service"), operated by Dylan Mabe (the "Seller", "we", "us"). By creating an account or using the Service you agree to these Terms.

1. The Service

ProfitForge AI is a generative-AI website builder. It helps individuals and businesses design, polish and deploy professional websites for legitimate purposes — including portfolios, small business sites, marketing pages, landing pages, side projects and client work. The Service produces standard web content (text, layout, copy, basic imagery) suitable for publishing on the open web.

2. Eligibility & Account

You must be of legal age and, if acting for an organisation, have authority to bind it. You are responsible for keeping account credentials confidential and for all activity under your account. Information you provide must be accurate and kept up to date.

3. Licence & Restrictions

We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You may not reverse engineer, resell or redistribute the Service itself, or circumvent technical limits. You own the website content you generate from your own inputs, subject to these Terms.

4. Acceptable Use

You must use the Service lawfully and responsibly. You agree that you will not use the Service, and will not allow anyone using your account to use it, to create, host, distribute, promote or facilitate any of the following:

We monitor for abuse and may refuse, filter or remove outputs, suspend or terminate accounts, and report illegal content to the relevant authorities. Repeated or serious violations result in immediate termination without refund.

5. AI Outputs & Inputs

You are responsible for the prompts you submit and for verifying the accuracy and suitability of any AI-generated output before using it. You must have the necessary rights to any content you submit. AI outputs may be inaccurate or incomplete and are not a substitute for professional advice. We may remove or restrict content, refuse or filter outputs, and suspend accounts to enforce these Terms. Rights-holders may submit takedown requests via the contact channel below; repeated infringement may result in termination.

6. Intellectual Property

We retain all rights in the Service, including its software, models, documentation and branding. Subject to your compliance with these Terms and any third-party model terms, you own the outputs you generate from your inputs.

7. Payments, Subscriptions, Refunds & Taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy. Subscriptions renew automatically until cancelled.

8. Suspension & Termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. On termination your right to use the Service ends; you may export your data for a reasonable window before it is deleted.

9. Warranties & Liability

The Service is provided "as is". To the fullest extent permitted by law we disclaim all implied warranties including merchantability and fitness for a particular purpose, and do not guarantee uninterrupted or error-free performance. Our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. We exclude liability for indirect, consequential or special damages (including loss of profits, data, or goodwill). Nothing limits liability for fraud, death or personal injury where the law forbids exclusion.

10. Indemnity

You will indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

11. Governing Law

These Terms are governed by the laws of the Seller's jurisdiction. Disputes will be resolved in the competent courts there.
